Welcome to Severn River Publishing (“SRP,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, apps, and online properties that link to these Terms (collectively, the “Site”). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1) Eligibility & Accounts

You must be at least 13 years old to use the Site and at least 18 to make purchases. If you create an account, you’re responsible for maintaining its confidentiality and for all activity under it. We may suspend or terminate your account or access at any time for violation of these Terms or applicable law.

2) Ownership & License to Use the Site

The Site (including text, images, logos, audio, video, designs, and code) is owned by SRP or our licensors and protected by IP laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial use. You may not: (a) copy, modify, distribute, or create derivative works; (b) reverse engineer or decompile any software; (c) use scraping, harvesting, or automated means to access the Site; (d) remove or alter notices; or (e) use the Site for competitive analysis or benchmarking without our written consent.

3) User Content (e.g., Reviews, Comments)

If the Site allows you to post or submit content (“User Content”), you grant SRP a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such User Content in connection with the Site. You represent you have all necessary rights and your User Content does not infringe or violate any law or third-party rights. We may remove User Content at any time.

4) Third-Party Links, Retailers & Affiliate Disclosure

The Site may link to third-party sites and retailers (e.g., Amazon) and may use link-management services to redirect you. We are not responsible for third-party sites or their practices.

5) E-Commerce Terms (Direct Purchases from SRP)

a. Orders & Acceptance. Your order is an offer to buy; we may accept or reject it. We may limit or cancel quantities.
b. Pricing & Taxes. Prices are shown in USD and exclude applicable taxes and shipping unless stated otherwise. We reserve the right to correct pricing or availability errors. If we make a pricing error, we may cancel your order and refund you.
c. Payment. You authorize us (and our payment processors) to charge your payment method for the total order amount. We may use third-party fraud prevention and may cancel or hold orders for verification.
d. Shipping, Risk of Loss & Title. Title and risk of loss for physical items pass to you upon our delivery to the carrier. Delivery dates are estimates and not guaranteed.
e. Returns, Refunds & Replacements. Any returns, refunds, replacements, or damage/defect remedies are as described on the applicable product page, in your order flow, or in our help/FAQ pages at the time of purchase. Where no specific policy is shown, sales are final except where required by law.
f. Promotions, Coupons & Free Offers. Promotions (including “free book” or discount codes), coupons, and special offers are subject to the terms disclosed at the time of the offer (e.g., eligibility, timing, limitations). We may modify or discontinue any promotion at any time.
g. Digital Content. If we offer digital content, licensing and delivery terms will be disclosed at purchase. Digital items are licensed, not sold, and may be subject to usage restrictions.
h. Export. You agree to comply with all export and import laws and regulations.

6) Acceptable Use

You may not use the Site to: violate laws; infringe IP, privacy, or publicity rights; transmit malware; engage in fraud; attempt to bypass security; or interfere with Site operations.

We do not guarantee uninterrupted or error-free operation or that the Site is free of harmful components.

9) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SRP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SITE OR PRODUCTS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SRP FOR THE PRODUCT OR SERVICE AT ISSUE IN THE 6 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100.

10) Indemnity

You will indemnify and hold SRP harmless from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the Site.

11) Privacy; Cookies; Targeted Advertising

Your use of the Site is subject to our Privacy Policy, which describes how we collect, use, and share data, including for analytics and targeted advertising. You can manage certain preferences via our cookie banner or by using the options described in the Privacy Policy.

12) Changes to the Site or Terms

We may modify the Site and update these Terms at any time. Changes are effective when posted, unless stated otherwise. Your continued use after changes means you accept them.

13) Governing Law & Venue

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflicts of law. You consent to exclusive jurisdiction and venue in the state or federal courts located in Loudoun County, Virginia.

14) Miscellaneous

If any provision is unenforceable, it will be severed, and the remainder will remain in effect. No waiver is effective unless in writing. You may not assign these Terms without our consent. These Terms constitute the entire agreement regarding the Site.
